TERMS AND CONDITIONS OF SALE

DEFINITIONS: Buyer(s) is defined as the original purchaser and or consumer (end user). Yost’s warranty does not transfer

beyond original purchaser and or consumer. Original proof of purchase is the sole responsibility of the consumer / purchaser

and is required for all warranty related claims. Warranty is non-transferable.

Consumable Items: Defined as parts that anticipate normal wear & tear and will require routine replacement. Items

classified as consumable items are as follows: VISE JAW CAPS, SERRATED AND OR

SMOOTH JAWS, PIPE JAWS, VISE MAIN SCREW AND NUT ASSEMBLIES, INNER V-

GROOVED LOCKING RING, CARRIAGE BOLTS, LOCK DOWNS AND ANCILLARY NON-

CAST HARDWARE SUCH AS ALLEN SCREWS.

The duration of the consumable product warranty is as follows: 90 days after receipt of goods.

Non-Consumable Items: Defined as castings. The duration of the non-consumable product warranty will remain in effect

as illustrated by Table -1 for the original purchaser / consumer.

CONTROLLING PROVISIONS: No terms and conditions other than the terms and conditions contained herein shall be binding upon Seller unless accepted by it in a writing signed by the Seller's Sales Manager.

TAXES: The amount of any sales, excise or other taxes, if any, applicable to the products shall be added to the purchase price and shall be paid by Buyer unless Buyer provides Seller with an exemption certificate acceptable to the taxing authorities.

NON-WAIVER: Seller's failure to insist upon the strict performance of any term or condition herein shall not be deemed a waiver of any of Seller's rights or remedies hereunder, nor of its right to insist upon the strict performance of the same or any other term herein in the future. No waiver of any term or condition hereunder shall be valid unless in writing and signed by Seller's General Manager or Officer of the Company.
