ThisarbitrationprovisionisgovernedbytheFederalArbitrationAct.Judgmentmaybe
enteredonthearbitrator’sawardinanycourtofcompetentjurisdiction.Allissuesare
forthearbitratortodecide,exceptthatissuesrelatingtothescopeandenforceabilityof
thearbitrationprovisionandtothearbitrabilityofthedisputeareforthecourttodecide.
Thearbitratorisboundbythetermsofthisprovision.
GoverningLaw:ThelawofthestateofyourresidenceshallgovernthisLimited
Warrantyandanydisputesbetweenusexcepttotheextentthatsuchlawispreempted
byorinconsistentwithapplicablefederallaw.
Fees/Costs.Youdonotneedtopayanyfeetobeginanarbitration.Uponreceiptof
yourwrittendemandforarbitration,LGwillpromptlypayallarbitrationfilingfeestothe
AAAunlessyouseekmorethan$25,000indamages,inwhichcasethepaymentof
thesefeeswillbegovernedbytheAAARules.Exceptasotherwiseprovidedforherein,
LGwillpayallAAAfiling,administrationandarbitratorfeesforanyarbitrationinitiated
inaccordancewiththeAAARulesandthisarbitrationprovision.Ifyouprevailinthe
arbitration,LGwillpayyourreasonableattorneys’feesandexpensestotheextent
requiredbyapplicablelaw.Ifthearbitratorfindseitherthesubstanceofyourclaimor
thereliefsoughtinthedemandisfrivolousorbroughtforanimproperpurpose(as
measuredbythestandardssetforthinFederalRuleofCivilProcedure11(b)),thenthe
paymentofallarbitrationfeeswillbegovernedbytheAAARules.Insuchasituation,
youagreetoreimburseLGforallmoniespreviouslydisbursedbyitthatareotherwise
yourobligationtopayundertheAAARules.Exceptasotherwiseprovidedfor,LGwaives
anyrightsitmayhavetoseekattorneys’feesandexpensesfromyouifLGprevailsin
thearbitration.
HearingsandLocation.Ifyourclaimisfor$25,000orless,youmaychoosetohavethe
arbitrationconductedsolelyonthebasisof(1)documentssubmittedtothearbitrator,
(2)throughatelephonichearing,or(3)byanin-personhearingasestablishedbythe
AAARules.Ifyourclaimexceeds$25,000,therighttoahearingwillbedeterminedby
theAAARules.Anyin-personarbitrationhearingswillbeheldatalocationwithinthe
federaljudicialdistrictinwhichyouresideunlesswebothagreetoanotherlocationor
weagreetoatelephonicarbitration.
