⚠ Battery warnings and device care:

This device contains a lithium-ion battery. The below guidelines must be followed in

order to maintain expected useful life of the device, and to reduce risk of damage to

device or personal injury.

Operating use temperature range: Recommend from 0 to 45 °C (32 to 113 °F).

Storage temperature range: Recommend from 10 to 40 °C (50 to 104 °F).

⚠ CAUTION: RISK OF EXPLOSION IF BATTERY IS REPLACED BY AN INCORRECT TYPE.

DISPOSE OF USED BATTERIES ACCORDING TO THE INSTRUCTIONS.

• Keeping clean and drying the device from moisture is recommended. Keeping USB port

and cover dry and free of debris is critical to the life of product and safety of consumers.

• Internal items of the Dash unit cannot be serviced. No items are serviceable and no at-

tempt should be made to adjust or alter any internal items.

• Do not expose device to high heat environments over the recommend temperatures, which

includes leaving the device in an unattended vehicle in direct sunlight.

• Never expose this device or battery to open ames, incineration, sharp or piercing objects,

chemicals, or the battery to water.

• Never expose battery to children, or allow them to chew or swallow any portion as chemi-

cal burns, injury, or death may result.

• Only power adapters with output of 5V DC, and maximum 500mA, should be used to

avoid device damage and/or electrical re. The use of USB splitters and hubs, or other

voltage DC output than 5V DC, should be used with extreme caution. It is also recom-

mended to use only direct plug-in sources, or splitters and hubs with only one device

inserted for charging.

⚠ Recycling/Disposal of device and battery warning: This device includes a lithium

ion battery. This device must not be mixed with general household waste. For proper

treatment, recovery and recycling, please take this product(s) to designated collection

points where it will be accepted free of charge. In compliance with your local laws and

regulations, please contact local authorities for end of life disposal of this product and

Health Warning:

Before beginning exercise or modifying any exercise program, consult your physician. If

Navigation Hazards:

The Stages device may have features that show and recommend off-road/trail routes,

please use extreme caution when following directions that are not navigationally

marked or suggest routes that are dangerous. Always be aware of safety hazards

whether on-road or off-road.

This device does not authorize anyone to disregard trafc laws or other regulations.

Always be aware of hazards while momentarily viewing on-screen data. Come to a

complete stop before using this device, which includes any manipulation of menus or

data viewing.

Environmental:

California Proposition 65: The enclosed hardware and its packaging contain chemicals

the State of California has found to cause cancer, birth defects or reproductive harm.

Warranty:

(1) One year limited warranty. In all cases a Return Authorization Number (RA#) must

be issued by Stages Cycling before any product is returned for warranty inspection and

service.

HOW CONSUMER LAW RELATES TO THIS WARRANTY

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER

RIGHTS THAT VARY FROM STATE TO STATE (OR BY COUNTRY OR PROVINCE). OTH-

ER THAN AS PERMITTED BY LAW, STAGES CYCLING DOES NOT EXCLUDE, LIMIT OR

SUSPEND OTHER RIGHTS YOU MAY HAVE. FOR A FULL UNDERSTANDING OF YOUR

RIGHTS YOU SHOULD CONSULT THE LAWS OF YOUR COUNTRY, PROVINCE OR STATE.

WARRANTY LIMITATIONS THAT MAY AFFECT CONSUMER LAW

TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET

FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND

CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. STAG-

ES CYCLING DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING

WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A

PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS,

TO THE EXTENT PERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT

BE DISCLAIMED, STAGES CYCLING LIMITS THE DURATION AND REMEDIES OF SUCH

WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT STAGES CY-

CLING’S OPTION, THE REPAIR OR REPLACEMENT SERVICES DESCRIBED BELOW. IN

NO EVENT WILL THE VALUE OF THE WARRANTY PROVIDED EXCEED THE ORIGINAL

PURCHASE PRICE. SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW

LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY (OR CONDITION) MAY LAST, SO

THE LIMITATION DESCRIBED ABOVE MAY NOT APPLY TO YOU.

WHAT IS COVERED BY THIS WARRANTY?

Stages Cycling warrants the Stages Cycling-branded hardware product and accesso-

ries contained in the original packaging (“Stages Cycling Product”) against defects in

materials and workmanship when used normally in accordance with Stages Cycling’s

published guidelines for a period of ONE (1) YEAR from the date of original retail pur-

chase by the end-user purchaser (“Warranty Period”). This warranty only applies to the

original owner and is not transferable.

WHAT IS NOT COVERED BY THIS WARRANTY?

This warranty applies to Stages Cycling branded products including but not limited to

crank arms when packaged or sold with Stages Cycling hardware. Manufacturers, sup-

pliers, or publishers, other than Stages Cycling, may provide their own warranties to you

but Stages Cycling, in so far as permitted by law, provides their products “AS IS”. Stages

Cycling does not warrant that the operation of the Stages Cycling Product will be unin-

terrupted or error-free. Stages Cycling is not responsible for damage arising from failure

to follow instructions relating to the Stages Cycling Product’s use. Stages Cycling’s

published guidelines include but are not limited to information contained in technical

specications, user manuals and service communications.

This warranty does not apply: (a) to consumable parts, such as batteries or protective

coatings that are designed to diminish over time, unless failure has occurred due to

a defect in materials or workmanship; (b) to cosmetic damage, including but not lim-

ited to scratches and dents; (c) to damage caused by use with another product; (d) to

damage caused by accident, impact, abuse, misuse, re, earthquake or other external

cause; (e) to damage caused by operating the Stages Cycling Product outside Stag-

es Cycling’s published guidelines; (f) to damage caused by service, modications or

alterations performed by anyone other than Stages Cycling or an authorized Stages

Cycling Service Provider (h) to defects caused by normal wear and tear or otherwise

due to the normal aging of the Stages Cycling Product, or (i) if any serial number has

been removed or defaced from the Stages Cycling Product.

IMPORTANT RESTRICTION

Stages Cycling may restrict warranty service to the country where Stages Cycling or its

Authorized Distributors originally sold the Stages Cycling Product.

Software license Agreement:

PLEASE READ THE FOLLOWING TERMS CAREFULLY. THESE TERMS GOVERN YOUR

USE OF THE SOFTWARE EMBEDDED IN THE DEVICE. BY USING THE DEVICE, YOU AC-

KNOWLEDGE THAT YOU HAVE READ, UNDERSTAND AND ACCEPT THESE TERMS, AND

YOU AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO ALL OF THESE TERMS,

DO NOT USE THE DEVICE.

Stages Cycling, LLC and its subsidiaries (“Stages”) grants you a non-transferable,

non-exclusive limited right and license to access, execute, display, perform and use the

software embedded in the device in executable form (the “Software”), solely for your

personal, non-commercial use in accordance with the intended operation of the device

and all related device documentation provided by Stages (“Documentation”). The fore-

going license shall apply to all programmatic or functional improvements and updates

to the Software, whether upgrades, new versions, modications, customizations, error

handling, bug xes or other improvements to the Software (collectively, “Updates”)

prompted by Stages from time to time or initiated by you in conformance with normal

operation of the device and all Documentation. The Software may include software,

data metrics, algorithms, formulas, trademarks and other intellectual property licensed

by a third party to Stages for use as part of the Software (“Third Party IP”). Stages

grants you a non-transferable, non-exclusive limited sublicense to execute, display, per-

form and use, in accordance with the license granted above and the other use and con-

dentiality restrictions set forth in this Software License Agreement, the Third Party IP.

The foregoing sublicense is subject to the following additional condition: the Third Party

IP will be used only in conjunction with any permissible use of the Software specically

authorized in this Software License Agreement.

The device may provide you with access to Stages’ website and mobile applications

(collectively, “Technology”), and certain features, functionality and content accessible

on or through the device may be hosted on the Technology. Your access to and use of

such features, functionality, and content may require you to acknowledge your accep-

tance to certain additional terms of use, rules or policies provided by Stages in connec-

tion with the Technology, and your failure to do so may restrict you from accessing or

using certain of the device’s features and functionality. Any violation of such additional

Software License Agreement.

The Software, Documentation, object code and source code for the Software, visual

expressions, screen formats, report formats and other design features of the Software,

all ideas, methods, algorithms, formulas and concepts incorporated into the Software

or Documentation, all future Updates to the Software, and all derivative works (as such

term is used in the U.S. copyright laws) based on any of the foregoing (collectively, “Pro-

prietary Property”) are trade secrets and proprietary property of Stages and its licensors,

and have great commercial value to Stages and its licensors. All Proprietary Property

is being provided to you on a strictly condential and limited use basis, subject to the

foregoing license. Title to all Proprietary Property and all related patent, copyright, trade-

mark, database right, trade secret, intellectual property and other ownership rights shall

remain exclusively with Stages and its licensors. This Software License Agreement is

not an agreement of sale, and no title, patent, copyright, trademark, trade secret, intellec-

tual property or other ownership rights to any Proprietary Property are transferred to you

by virtue of this Software License Agreement or your purchase of the device. You will

not, and will not allow any third party to: (i) license, sublicense, resell, rent, lend, transfer,

assign, distribute, or otherwise commercially exploit or make available to any third party

any of the Proprietary Property in any way; (ii) copy, modify, adapt, alter, translate, or

create derivative works of the Proprietary Property; (iii) use, merge, or aggregate the Pro-

prietary Property, or any component or element thereof, with other software, databases,

or services not provided by Stages; (iv) reverse engineer, decompile, disassemble, or

otherwise attempt to derive the structure of the Proprietary Property; (v) circumvent,

or attempt to circumvent, any electronic protection measures in place to regulate or

control access to the Proprietary Property; (vi) use the Proprietary Property for unlawful

purposes; (vii) use any robot, spider, app search/retrieval application, or other manual or

automatic device to retrieve, index, “scrape,” “data mine,” or in any way gather the Propri-

etary Property; or (viii) remove, delete, alter or obscure any trademarks or any copyright,

trademark, patent or other intellectual property or proprietary rights notices from the

Proprietary Property. Stages reserves the right to investigate and prosecute violations

of any of the above obligations to the fullest extent of the law. Stages may involve and

cooperate with law enforcement authorities in prosecuting users who violate this Soft-

ware License Agreement.

This Software License Agreement shall be governed, construed, interpreted and en-

forced in accordance with the laws of the State of Colorado, USA, without reference to

its conicts or choice of law principles. You agree that the sole and exclusive jurisdiction

and venue for any and all disputes arising under this Software License Agreement shall

be in any federal or state court located in or having jurisdiction over Boulder County,

Colorado, and you consent to the personal jurisdiction of such courts. You hereby waive

any and all objections which you may now or hereafter have to the exercise of personal

and subject matter jurisdiction by such federal or state courts and to the laying of venue

of any such suit, action, or proceeding brought in any such federal or state court.

FCC Compliance Statement:

This equipment has been tested and found to comply with the limits for a Class B digital

device, pursuant to part 15 of the FCC Rules. These limits are designed to provide rea-

sonable protection against harmful interference in a residential installation. This equip-

ment generates, uses, and can radiate radio frequency energy and, if not installed and

used in accordance with the instructions, may cause harmful interference to radio com-

munications. However, there is no guarantee that interference will not occur in a partic-

ular installation. If this equipment does cause harmful interference to radio or television

Stages Cycling gibt für das Produkt und das Zubehör der Marke Stages Cycling, das in

ling gibt keine Garantie dafür, dass der Betrieb des Stages Cycling Produkts unterbre-

chungsfrei oder fehlerfrei sein wird. Stages Cycling ist nicht verantwortlich für Schäden,

die aus dem Nichtbefolgen der Anweisungen entstehen, die sich auf die Nutzung des

Stages Cycling Produkts beziehen. Die von Stages Cycling veröffentlichten Richtlinien

beinhalten u. a. Informationen, die in technischen Spezikationen, Bedienungshandbü-

chern und Service-Kommunikationen enthalten sind.

Diese Garantie gilt nicht für: (a) Verbrauchsmaterialien, wie Batterien oder Schutzbe-

schichtungen, die darauf ausgelegt sind, im Laufe der Zeit nachzulassen, sofern nicht

eine Störung aufgrund eines Material- oder Verarbeitungsfehlers aufgetreten ist; (b)

kosmetische Schäden, einschließlich u. a. Kratzer und Dellen; (c) Schäden, die durch

die Nutzung mit einem anderen Produkt entstehen; (d) Schäden, die durch einen Un-

fall, Aufprall, missbräuchliche Nutzung, falschen Einsatz, Feuer, Erdbeben oder andere

äußere Ursachen entstehen; (e) Schäden, die durch den Betrieb des Stages Cycling

Produkts außerhalb der von Stages Cycling veröffentlichten Richtlinien entstehen; (f)

Schäden, die durch Service, Modizierungen oder Änderungen, die nicht von Stages

Cycling oder einem von Stages Cycling autorisierten Anbieter durchgeführt wurden,

entstehen; (h) Mängel, die durch normale Abnutzung oder durch die normale Alterung

des Stages Cycling Produkts entstehen, oder (i) wenn Seriennummern auf den Stages

Cycling Produkten entfernt oder unkenntlich gemacht wurden.

WICHTIGE EINSCHRÄNKUNG

Stages Cycling kann den Garantieservice auf das Land begrenzen, in dem Stages Cyc-

ling oder seine autorisierten Vertriebshändler das Stages Cycling Produkt ursprünglich

verkauft haben.

VERSTANDEN UND AKZEPTIERT ZU HABEN, UND STIMMEN ZU, DARAN GEBUNDEN

ZU SEIN. WENN SIE NICHT MIT ALL DIESEN BEDINGUNGEN EINVERSTANDEN SIND,

DÜRFEN SIE DAS GERÄT NICHT VERWENDEN.

Stages Cycling LLC und dessen Tochtergesellschaften („Stages“) gewähren Ihnen ein

nicht übertragbares, nicht exklusives, eingeschränktes Recht und die Lizenz für den Zu-

gang, die Ausführung, die Anzeige, die Durchführung und die Verwendung der in das Ge-

rät integrierten Software in ausführbarer Form (die „Software“). Dies gilt ausschließlich

für Ihr Personal, zur nicht kommerziellen Verwendung gemäß dem Bestimmungszweck

des Geräts sowie für die gesamte damit in Zusammenhang stehende Gerätedokumen-

tation, die von Stages bereitgestellt wird (die „Dokumentation“). Die oben genannte

Lizenz gilt für alle programmatischen oder funktionellen Verbesserungen und Updates

der Software, gleichermaßen Upgrades, neue Versionen, Modizierungen, individuelle

Gestaltungen, Fehlerbehandlungen und -behebungen oder andere Verbesserungen an

der Software (gemeinsam die „Updates“), die von Zeit zu Zeit von Stages veröffent-

licht oder von Ihnen während des normalen Betriebs des Geräts und der gesamten

Dokumentation veranlasst werden. Die Software könnte Softwares, metrische Daten,

Algorithmen, Formeln, Warenzeichen und anderes geistiges Eigentum beinhalten, das

von Dritten zur Verwendung im Rahmen der Software an Stages lizenziert wurde (das

„geistige Eigentum Dritter“). Stages gewährt Ihnen eine nicht übertragbare, nicht ex-

klusive, eingeschränkte Unterlizenz für die Ausführung, Anzeige, Durchführung und Ver-

wendung gemäß der oben genannten Lizenz sowie gemäß anderen Nutzungs- und Ver-

schwiegenheitsbeschränkungen, die in diesem Software-Lizenzvertrag, dem geistigen

Eigentum Dritter, beschrieben werden. Die oben genannte Unterlizenz unterliegt den

folgenden zusätzlichen Bedingungen: Das geistige Eigentum Dritter darf nur in Zusam-

menhang mit einer zulässigen Nutzung der Software verwendet werden, die in diesem

Software-Lizenzvertrag ausdrücklich autorisiert ist.

Das Gerät könnte Ihnen Zugriff auf die Website und Apps von Stages (gemeinsam die

„Technologie“) gewähren und bestimmte Merkmale, Funktionen und Inhalte, die auf

oder über das Gerät zugänglich sind, könnten von der Technologie gehostet werden.

Bei Ihrem Zugriff auf und die Nutzung von solchen Merkmalen, Funktionen und Inhal-

ten könnte es erforderlich sein, dass Sie bestimmten weiteren Nutzungsbedingungen,

Regeln oder Bestimmungen zustimmen, die Stages in Zusammenhang mit der Techno-

logie vorgibt. Wenn Sie damit nicht einverstanden sind, sind Sie im Zugriff auf oder in

der Nutzung bestimmter Merkmale und Funktionen des Geräts möglicherweise einge-

schränkt. Jedweder Verstoß gegen solche zusätzliche Nutzungsbedingungen, Regeln

oder Bestimmungen, die von Stages vorgegeben werden, werden auch als Verstoß

gegen diesen Software-Lizenzvertrag erachtet.

Die Software, die Dokumentation, der Zielcode und der Quellcode für die Software, vi-

suelle Ausdrücke, Bildschirmformate, Berichtformate und andere Designmerkmale der

Software, alle Ideen, Methoden, Algorithmen, Formeln und Konzepte, die in die Software

oder Dokumentation integriert sind, alle zukünftigen Updates der Software und alle da-

raus resultierenden Arbeiten (gemäß den Bestimmungen der US-amerikanischen Urhe-

berrechtsgesetze), die auf dem oben Gesagten basieren (gemeinsam das „geschützte

Eigentum“), sind Geschäftsgeheimnisse und geschütztes Eigentum von Stages und

dessen Lizenzgeber und sind für Stages und dessen Lizenzgeber von großem kom-

merziellem Wert. Das gesamte geschützte Eigentum wird Ihnen streng vertraulich und

zur eingeschränkten Nutzung zur Verfügung gestellt und unterliegt der oben genannten

Lizenz. Das Eigentumsrecht des gesamten geschützten Eigentums und aller damit in

Zusammenhang stehenden Patente, Urheberrechte, Warenzeichen, Datenbankrechte,

Geschäftsgeheimnisse, geistigen Eigentums und anderer Eigentumsrechte bleiben aus-

schließlich bei Stages und dessen Lizenzgebern. Dieser Software-Lizenzvertrag ist kein

Kaufvertrag und kein Eigentumsrecht, Patent, Urheberrecht, Warenzeichen, Geschäfts-

geheimnis, geistiges Eigentum oder anderes Eigentumsrecht an geschütztem Eigentum

wird durch dieses Software-Lizenzabkommen oder Ihren Kauf des Geräts an Sie über-

tragen. Sie dürfen Dritten keinesfalls erlauben, (i) das geschützte Eigentum auf irgend-

eine Weise zu lizenzieren, unterzulizenzieren, weiterzuverkaufen, zu mieten, zu leihen, zu

übertragen, zuzuweisen, zu verteilen oder anderweitig kommerziell zu nutzen; (ii) das ge-

schützte Eigentum zu kopieren, zu modizieren, anzupassen, zu ändern, zu übersetzen

oder daraus resultierende Arbeiten zu erstellen; (iii) das geschützte Eigentum bzw. Teile

oder Elemente davon mit anderen Softwares, Datenbanken oder Diensten, die nicht von

Stages bereitgestellt werden, zu verwenden, zusammenzufügen oder zu sammeln; (iv)

das geschützte Eigentum rückzuentwickeln, auseinanderzubauen oder auf andere Wei-

se zu versuchen, dessen Struktur abzuleiten; (v) elektronische Schutzvorrichtungen zu

umgehen oder zu umgehen versuchen, um den Zugriff auf das geschützte Eigentum zu

regeln oder zu kontrollieren; (vi) das geschützte Eigentum zu rechtswidrigen Zwecken

zu verwenden; (vii) Roboter, App-Such-/Abrufanwendungen oder andere manuelle oder

automatische Geräte zu verwenden, um geistiges Eigentum abzurufen, zu indizieren, zu

gewinnen, zu sammeln oder auf andere Weise zu erlangen; oder (viii) etwaige Warenzei-

chen oder Urheberrechte, Warenzeichen, Patente oder anderes geistiges Eigentum oder

Eigentumsrechte des geschützten Eigentums zu entfernen, zu löschen, zu modizieren

oder zu verbergen. Stages behält sich das Recht vor, Verstöße gegen die oben genann-

ten Verpichtungen im Rahmen aller gesetzlichen Möglichkeiten zu untersuchen und zu

verfolgen. Stages kann mit Gesetzesvollzugsbehörden zusammenarbeiten, um Nutzer

zu verfolgen, die gegen diesen Software-Lizenzvertrag verstoßen.

Dieser Software-Lizenzvertrag muss gemäß den Gesetzen des US-Bundesstaates Co-

lorado und ohne Bezugnahme auf dessen Konikt- oder Rechtswahlprinzipien geregelt,

ausgelegt, interpretiert und umgesetzt werden. Sie erklären sich damit einverstanden,

dass die einzige und ausschließliche Rechtsprechung und der Gerichtsstand im Fall

etwaiger Streitigkeiten im Rahmen dieses Software-Lizenzvertrags ein staatliches oder

bundesstaatliches Gericht in Colorado oder ein Gericht, das die Rechtsprechung über

Boulder County innehat, sein müssen, und Sie stimmen der personenbezogenen Zustän-

digkeit solcher Gerichte zu. Sie verzichten hiermit auf alle Einwände, die Sie hinsichtlich

der personen- oder sachbezogenen Zuständigkeit solcher staatlicher oder bundesstaat-

licher Gerichte und hinsichtlich der Bestimmung des Gerichtsstandes einer solchen

Klage, Prozesses oder Verfahrens, das bei einem staatlichen oder bundesstaatlichen

Gericht eingebracht wird, nun oder zu einem späteren Zeitpunkten haben könnten.

Y LAS GARANTÍAS POR VICIOS O DEFECTOS OCULTOS, DENTRO DE LOS TÉRMINOS

PERMITIDOS POR LA LEY. EN CASO DE QUE NO RESULTE POSIBLE ANULAR DICHAS

GARANTÍAS, STAGES CYCLING LIMITA LA DURACIÓN Y LAS ACCIONES ASOCIADAS

A DICHAS GARANTÍAS A LA DURACIÓN DE ESTA GARANTÍA EXPRESA Y, A DISCRE-

CIÓN DE STAGES CYCLING, TAMBIÉN LOS SERVICIOS DE REPARACIÓN O SUSTITUCIÓN

DESCRITOS A CONTINUACIÓN. EN NINGÚN CASO PODRÁ EL VALOR DE LA GARANTÍA

CONCEDIDA SUPERAR EL PRECIO DE COMPRA ORIGINAL. ALGUNAS NORMAS NACIO-

DURACIÓN DE LAS GARANTÍAS (O CONDICIONES) TÁCITAS. SI ESE ES SU CASO, NO LE

COBERTURA DE LA GARANTÍA

Stages Cycling garantiza que el hardware de la marca Stages Cycling y sus accesorios

incluidos en el embalaje original (en adelante, el “Producto de Stages Cycling”) no pre-

sentarán defectos en los materiales ni defectos de fabricación cuando se haga un uso

normal de los mismos de acuerdo con las directrices publicadas por Stages Cycling,

durante un periodo de UN (1) AÑO a partir de la fecha de compra original en la tienda por

el usuario nal (en adelante, el “Periodo de la Garantía”). Esta garantía solo se concede al

propietario original. No es transferible.

ELEMENTOS NO CUBIERTOS POR LA GARANTÍA

jación de Stages Cycling. Otros fabricantes, proveedores y anunciantes distintos de Sta-

Stages Cycling proporciona sus productos “TAL CUAL”, sin otras garantías adicionales.

Stages Cycling no garantiza un funcionamiento ininterrumpido y sin errores del Producto

de Stages Cycling. Además, Stages Cycling no se hace responsable de los daños que se

derivados de un uso del Producto de Stages Cycling que incumpla las directrices publi-

o alteraciones realizadas por personas ajenas a Stages Cycling y a los proveedores de

servicios autorizados por Stages Cycling (h) los defectos provocados por un desgaste

normal o debidos al envejecimiento normal del Producto de Stages Cycling, o (i) nin-

guna reclamación cuando se haya retirado o borrado cualquier número de serie del

producto de Stages Cycling.

LIMITACIÓN IMPORTANTE

Stages Cycling, LLC y sus subsidiarias (“Stages”) le otorgan un derecho y una licencia li-

mitados, no transferibles, no exclusivos, para acceder, ejecutar, mostrar, realizar y utilizar

el software incorporado en el dispositivo de forma ejecutable (el “software”), únicamen-

te para su uso personal y no comercial, de acuerdo con el funcionamiento previsto del

dispositivo y con toda la documentación relacionada con el dispositivo proporcionada

por Stages (“Documentación”). La licencia anterior se aplicará a todas las mejoras de

programación o funcionales, y a las actualizaciones del software, ya sean mejoras de

camente autorizado por este Acuerdo de Licencia de software.

El dispositivo puede proporcionarle acceso a la página web de Stages y a las aplica-

y contenido accesibles en o a través del dispositivo pueden alojarse en la Tecnología.

Licencia de software.

El software, la documentación, el código objeto y el código fuente del software, expre-

siones visuales, formatos de pantalla, formatos de informe y otras características de

diseño del Software, así como todas las ideas, métodos, algoritmos, fórmulas y concep-

tos incorporados en el software o la documentación, todas las actualizaciones futuras

del Software y todos los trabajos derivados (tal como se utiliza este término en las leyes

de derechos de autor de Estados Unidos) basados en cualquiera de los anteriores (co-

lectivamente, “Propiedad exclusiva”) son secretos comerciales y propiedad exclusiva de

Stages y sus licenciantes, y tienen gran valor comercial para Stages y sus licenciantes.

El título de propiedad exclusiva se otorga en base a un uso estrictamente condencial

y limitado, sujeto a la licencia anterior. El título de propiedad exclusiva y todos los dere-

chos de patentes, derechos de autor, marcas comerciales, derechos de base de datos,

secretos comerciales, propiedad intelectual y otros derechos de propiedad relacionados

permanecerán exclusivamente con Stages y sus licenciantes. Este Contrato de Licencia

de software no es un acuerdo de venta, y ningún título, patente, derecho de propiedad,

marca registrada, secreto comercial, propiedad intelectual u otros derechos de propie-

dad exclusiva le son transferidos en virtud de este Contrato de Licencia de software o

de su compra del dispositivo. Ni a usted, como titular, ni a terceros les estará permitido

(I) licenciar, sublicenciar, revender, alquilar, prestar, transferir, asignar, distribuir o explotar

de cualquier otra forma comercial o poner a disposición de terceros cualquier Propiedad

exclusiva de ninguna forma; (II) copiar, modicar, adaptar, alterar, traducir o crear obras

derivadas de la Propiedad exclusiva; (III) utilizar, fusionar o agregar la Propiedad exclusi-

va, o cualquier componente o elemento de la misma, con otro software, bases de datos

o servicios no proporcionados por Stages; (IV) realizar ingeniería inversa, descompilar,

desensamblar o intentar de otra manera derivar la estructura de la Propiedad exclusiva;

(V) eludir, o tratar de eludir, cualquier medida de protección electrónica establecida para

regular o controlar el acceso a la Propiedad exclusiva; (VI) utilizar la Propiedad exclusiva

para nes ilícitos; (VII) utilizar cualquier robot, araña, aplicación de búsqueda/recupe-

ración de aplicaciones u otro dispositivo manual o automático para recuperar, indexar,

“raspar”, “extraer datos” o de alguna manera recopilar la Propiedad exclusiva; o (VIII)

eliminar, borrar, alterar u ocultar marcas registradas o derechos de autor, marcas regis-

tradas, patentes u otros derechos de propiedad intelectual o derechos de propiedad de la

Propiedad exclusiva. Stages se reserva el derecho de investigar y enjuiciar las infraccio-

nes de cualquiera de las obligaciones anteriores hasta el máximo de la ley. Stages puede

involucrar a las autoridades policiales, y cooperar con ellas, para procesar a los usuarios

que infrinjan este Contrato de Licencia de software.

Este Contrato de Licencia de software se regirá, interpretará y gobernará de conformidad

con las leyes del Estado de Colorado, Estados Unidos, sin referencia a sus conictos o

elección de principios de derecho. El titular acepta que la jurisdicción única y exclusiva y

el lugar para cualquier disputa que surja bajo este Contrato de Licencia de software será

en cualquier tribunal federal o estatal ubicado en o con jurisdicción sobre el Condado

de Boulder, Colorado, y acepta la jurisdicción personal de dichos tribunales . El titular

renuncia a todas y cada una de las objeciones que pudiera plantear ahora o en el futuro

QU’EST-CE QUI EST COUVERT PAR CETTE GARANTIE ?

Stages Cycling garantit le matériel et les accessoires de marque Stages Cycling conte-

nus dans cet emballage d’origine (le « Produit Stages Cycling ») contre tout défaut ma-

tériel et de fabrication dans le cadre d’une utilisation normale respectant les indications

publiées par Stages Cycling, pour une période d’UN (1) AN à partir de la date d’achat

d’origine par l’acheteur initial (la « période de garantie »). Cette garantie s’applique seule-

ment au propriétaire original et n’est pas transférable.

QU’EST-CE QUI N’EST PAS COUVERT PAR CETTE GARANTIE ?

Cette garantie s’applique aux produits de marque Stages Cycling, comprenant sans

toutefois s’y limiter, les bras de manivelle fournis dans un emballage Stages Cycling ou

vendus avec du matériel Stages Cycling. Les fabricants, fournisseurs ou éditeurs autres

que Stages Cycling peuvent vous fournir leurs propres garanties, mais Stages Cycling,

dans les limites prévues par la loi, offre ses produits « TELS QUELS ». Stages Cycling ne

garantit pas un fonctionnement ininterrompu ni sans erreurs du Produit Stages Cycling.

Stages Cycling n’est pas responsable des dommages issus du non-respect des instruc-

fournisseur de service homologué par Stages Cycling (h) aux défauts causés par une

usure normale ou du fait du vieillissement normal du Produit Stages Cycling ou (i) si le

numéro de série a été supprimé ou dégradé sur le Produit Stages Cycling.

Stages Cycling peut restreindre sa garantie au pays où Stages Cycling et ses Distribu-

Stages Cycling, LLC et ses filiales (« Stages ») vous accordent un droit et une licence

limités, non-transférables et non-exclusifs d’accéder à, d’exécuter, d’afficher, de faire

fonctionner et d’utiliser le logiciel inclus dans l’appareil sous forme exécutable (le « Lo-

giciel »), à des fins personnelles et non commerciales uniquement, en accord avec le

fonctionnement prévu de l’appareil et de la documentation y-relative de l’appareil fournie

par Stages (« la Documentation »). La présente licence s’applique à toutes les amélio-

rations et mises à jour programmatiques et fonctionnelles apportées au Logiciel, qu’il

s’agisse de mise à niveau, de nouvelles versions, de modifications, de personnalisations,

de gestion des erreurs, de corrections de bogues ou d’autres améliorations apportées au

Logiciel (collectivement les « Mises à jour ») de temps à autre et à l’initiative de Stages ou

de vous-même, dans le cadre d’une utilisation normale de l’appareil et de la Documenta-

tion. Le Logiciel peut inclure le logiciel, des métriques de données, des algorithmes, des

formules, des marques commerciales et la propriété intellectuelle sous licence d’un tiers

octroyée à Stages pour une utilisation dans le cadre du Logiciel (« PI de tiers »). Stages

vous accorde une sous-licence limitée, non-transférable et non-exclusive d’exécuter, af-

autorisé du Logiciel spécifiquement autorisé dans ce Contrat de licence du logiciel.

L’appareil peut vous donner accès au site Web et aux applications mobiles Stages (col-

lectivement “la Technologie”) et à certains caractéristiques, fonctionnalités et contenus

accessibles sur ou via l’appareil peuvent être hébergés sur la Technologie. Votre accès

à et votre utilisation de ces caractéristiques, fonctionnalités et contenus peuvent néces-

siter votre acceptation de certaines conditions d’utilisation, règles ou politiques supplé-

comme une violation de ce Contrat de licence du logiciel.

Le Logiciel, la Documentation, le code objet et le code source du Logiciel, les expres-

sions visuelles, les formats d’écran, les formats de rapport et les autres caractéristiques

conceptuelles du Logiciel, l’ensemble des idées, méthodes, algorithmes, formules et

concepts incorporés dans le Logiciel ou la Documentation, toutes les Mises à jour à

venir du Logiciel et tous les travaux dérivés (comme les termes utilisé dans les lois de

exclusive ») sont des secrets commerciaux et la propriété exclusive de Stages et de ses

concédants et ont une grande valeur commerciale pour Stages et ses concédants. Toute

Propriété exclusive vous est fournie sur une base d’utilisation limitée et confidentielle,

soumise à la présente licence. Les titres de toute Propriété exclusive et l’ensemble

des brevets, copyrights, marques commerciales, droits de bases de données, secrets

commerciaux, propriétés intellectuelles et autres droits de propriété demeurent exclu-

sivement ceux de Stages et de ces concédants. Ce Contrat de licence du logiciel n’est

pas un accord de vente, et aucun des brevets, copyrights, marques commerciales, droits

de bases de données, secrets commerciaux, propriétés intellectuelles et autres droits

de propriété ne vous sont transférés en vertu de ce Contrat de licence du logiciel ou

de l’achat de votre matériel. Vous ne pouvez pas, ni ne pouvez autoriser aucun tiers à :

(i) accorder une licence, accorder une sous-licence, revendre, louer, transférer, affecter,

distribuer ou utiliser à des fins commerciales ou mettre à disposition de tiers tout ou

partie de la Propriété exclusive de quelque forme que ce soit ; (ii) copier, modifier, adapter,

traduire ou créer des versions dérivées de la Propriété exclusive ; (iii) utiliser, fusionner

ou agréger la Propriété exclusive ou tout composant ou élément qui en résulte, avec

d’autres logiciels, bases de données ou services non fournis par Stages ; (iv) inverser

la conception, décompiler, désassembler ou tenter de quelque manière que ce soit de

dériver la structure de la Propriété exclusive ; (v) déjouer ou tenter de déjouer toute me-

sure de protection électronique en place pour réguler ou contrôler l’accès à la Propriété

exclusive ; (vi) utiliser la Propriété exclusive à des fins contraires à la loi ; (vii) utiliser

tout robot, moteur de recherche, application de recherche ou autre appareil manuel ou

automatique pour extraire, répertorier ou explorer des données, ou de quelque façon que

ce soit compiler la Propriété exclusive ; or (viii) supprimer, effacer, modifier ou masquer

toute marque commerciale ou copyright, marque commerciale, brevet ou autre propriété

intellectuelle ou avis de droits de propriété de la Propriété exclusive. Stages se réserve

le droit d’enquêter et d’intenter des poursuites contre les violations de toute obligation

ci-dessus dans la pleine mesure où la loi le permet. Stages peut impliquer ou coopérer

avec les autorités chargées de l’application de la loi pour poursuivre les utilisateurs impli-

qués dans la violation de ce Contrat de licence du logiciel.

Le présent contrat est régi, interprété et appliqué conformément aux lois de l’État du Co-

lorado aux États-Unis, sans que ses règles de conflits ou choix des lois ne soient prises

en compte. Vous acceptez la compétence d’attribution et la compétence territoriale

exclusives pour tous litiges à propos du Contrat de licence du logiciel, de tout tribunal

fédéral ou d’État situé ou ayant autorité sur le comté de Boulder au Colorado et vous

vous soumettez à la compétence personnelle de ces tribunaux. Vous renoncez de fait à

toute plainte que vous pourriez avoir, maintenant ou par la suite, dans l’exercice des com-

pétences personnelles et matérielles par de tels tribunaux fédéraux ou d’État et de toute

poursuite, action ou procédure présentées aux tribunaux fédéraux ou d’État.

COSA COPRE QUESTA GARANZIA?

Stages Cycling garantisce il prodotto hardware e gli accessori di marchio Stages Cycling

contenuti nella confezione originale (il “prodotto Stages Cycling”) da difetti dei materiali

e di fabbricazione quando utilizzati normalmente in conformità alle linee guida pubblica-

te da Stages Cycling per un periodo di UN (1) ANNO dalla data di acquisto al dettaglio

originale da parte dell’acquirente nale (il “periodo di garanzia”). Questa garanzia vale

esclusivamente per il proprietario originale e non è trasferibile.

COSA NON COPRE QUESTA GARANZIA?

Questa garanzia si applica ai prodotti di marchio Stages Cycling comprendenti tra l’altro

le pedivelle quando confezionate e vendute unitamente al dispositivo Stages Cycling.

Costruttori, fornitori o editori diversi da Stages Cycling, possono fornire le proprie garan-

zie ma Stages Cycling, nella misura in cui consentito dalla legge, fornisce i loro prodotti

difetti causati dalla normale usura o diversamente dovuti al normale invecchiamento

del prodotto Stages Cycling, oppure (i) se il numero di serie è stato rimosso o cancellato

dal prodotto Stages Cycling.

Stages Cycling può limitare l’assistenza in garanzia ai paesi in cui Stages Cycling o i

Stages Cycling, LLC e le sue controllate (“Stages”) conferiscono un diritto limitato di li-

cenza non trasferibile e non esclusiva, per accedere, eseguire, visualizzare, eseguire e uti-

lizzare il software integrato nel dispositivo in forma eseguibile (il “Software”), unicamente

per l’uso personale, non commerciale, conformemente alla destinazione d’uso del dispo-

sitivo e tutti i documenti correlati al dispositivo forniti da Stages (“Documentazione”). La

suddetta licenza si applica a tutti i miglioramenti e gli aggiornamenti programmatici o

funzionali al Software, che siano aggiornamenti, nuove versioni, modiche, personaliz-

zazioni, gestione degli errori, bug x o altri miglioramenti al Software (collettivamente

denominati “Aggiornamenti”) sollecitati di volta in volta da Stages o avviati da Lei in con-

formità al normale funzionamento del dispositivo e a tutta la Documentazione. Il Softwa-

re può comprendere software, misure dei dati, algoritmi, formule, marchi commerciali e

altre proprietà intellettuali concessi in licenza da terzi a Stages per essere impiegati con

il Software (“IP di terzi”). Stages garantisce una sublicenza limitata, non trasferibile e non

esclusiva per attuare, visualizzare, eseguire e utilizzare l’IP di terzi, in conformità con la

licenza assegnata sopra e le altre limitazioni di uso e riservatezza denite dal presente

Contratto di licenza software. La suddetta sublicenza è soggetta alla seguente condizio-

ne supplementare: l’IP di terzi verrà utilizzato solo in abbinamento a tutti gli usi ammessi

del Software specicamente autorizzati nel presente Contratto di licenza software.

Il dispositivo può fornire l’accesso al sito internet e alle applicazioni mobili Stages’ (col-

lettivamente deniti “Tecnologia”) e alcune caratteristiche, funzioni e contenuti acces-

sibili su o tramite il dispositivo possono essere pubblicati sulla Tecnologia. L’accesso

e l’utilizzo di tali caratteristiche, funzioni e contenuti possono richiedere di confermare

l’accettazione di alcune condizioni di utilizzo, regole o politiche supplementari indicate

da Stages in relazione alla Tecnologia e, in mancanza di tale accettazione, Stages può

limitare l’accesso o l’uso di alcune caratteristiche o funzioni del dispositivo. La violazione

di tali condizioni di utilizzo, regole o politiche indicate da Stages verrà considerata una

violazione al presente Contratto di licenza software.

Il Software, la Documentazione, il codice oggetto e il codice fonte per il Software, le

espressioni visive, i formati delle schermate, i formati dei report e altre caratteristiche

di progettazione del Software, tutte le idee, i metodi, gli algoritmi, le formule e i concet-

ti incorporati nel Software o nella Documentazione, tutti gli Aggiornamenti futuri del

Software e tutte le opere da essi derivati (così come tale termine è inteso nelle legisla-

zioni in tema di diritto d’autore vigenti negli Stati Uniti) basate su quanto indicato sopra

(collettivamente denominati, “Diritti di proprietà”) sono segreti commerciali e di proprietà

esclusiva di Stages e dei suoi concessori e hanno un grande valore commerciale per

Stages e i suoi concessori. Tutti i diritti di proprietà sono concessi su base strettamente

riservata e per uso limitato, soggetto alla su indicata licenza. Il titolo di tutti i diritti di

proprietà e i relativi brevetti, i diritti d’autore, marchi commerciali, diritti sulle banche dati,

segreti commerciali, proprietà intellettuali e altri diritti patrimoniali restano di esclusivo

appannaggio di Stages e dei suoi concessori. Il presente Contratto di licenza software

non costituisce un accordo di vendita, e nessun titolo, brevetto, diritto d’autore, marchio

commerciale, segreto commerciale, proprietà intellettuale o altra proprietà è trasferito in

virtù del presente Contratto di licenza software o dell’acquisto del dispositivo. Lei non

potrà (e non lo consentirà a terzi) effettuare una delle seguenti attività: (i) rilasciare una

licenza o una sublicenza, rivendere, noleggiare, prestare, trasferire, assegnare, distribu-

ire, o sfruttare commercialmente in altro modo o rendere comunque disponibile a terzi

la proprietà; (ii) copiare, modicare, adattare, alterare, tradurre o creare opere da essi

derivati della proprietà; (iii) utilizzare, accorpare o aggregare la proprietà, o un suo com-

ponente o elemento, con un altro software, banche dati o servizi non forniti da Stages; (iv)

sottoporre a reverse engineering, decompilare, disassemblare o tentare diversamente di

derivarne l’assetto della proprietà; (v) eludere o cercare di eludere le misure di protezione

elettronica per regolare o controllare l’accesso al diritto di proprietà; (vi) utilizzare il diritto

di proprietà per ni illeciti; (vii) utilizzare robot, programmi spider, applicazione di ricerca/

recupero del sito o altro dispositivo manuale o automatico per recuperare, indicizzare,

realizzare attività di “scraping”, “data mining” o comunque accumulare il diritto di pro-

prietà; o (viii) rimuovere, occultare, alterare o oscurare avvisi di marchi commerciali o

diritti d’autore, marchi commerciali, brevetti o altra proprietà intellettuale dal diritto di pro-

prietà. Stages si riserva il diritto di indagare e perseguire legalmente ogni violazione dei

suddetti obblighi nella misura massima consentita dalla legge. Stages potrà coinvolgere

e collaborare con le autorità giudiziarie nel perseguire gli utenti che violano il presente

Questo Contratto di licenza software è regolato, interpretato e fatto valere in conformità

prevarrà sempre quella del Colorado. Accetta che qualsiasi controversia riferibile al pre-

sente Contratto di licenza software sarà di competenza esclusiva e verrà giudicata in un

tribunale statale o federale situato e che ha la competenza su Boulder County, Colorado,

e acconsente di rimettersi alla giurisdizione di tale tribunale. Si impegna espressamente

a non sollevare alcuna obiezione, che possa sorgere adesso o successivamente, all’e-

sercizio della competenza personale e giurisdizionale da parte di tali tribunali statali o

federali e in merito alla sede di presentazione di querele, azioni o procedimenti che si

svolgano in uno di tali tribunali statali o federali.

Stages Cycling, LLC og virksomhedens datterselskaber (“Stages”) giver dig en ikke-over-

dragelig, ikke-eksklusiv, begrænset ret og licens til at få adgang til, køre, vise, udføre og

bruge softwaren, der er i enheden, i eksekverbar form (“softwaren”) udelukkende til din

personlige, ikke-kommercielle anvendelse i overensstemmelse med den tiltænkte anven-

delse af enheden samt al relateret dokumentation til enheden, som leveret af Stages

(“dokumentation”). Ovennævnte licens gælder alle programmatiske eller funktionelle

forbedringer og opdateringer af softwaren, hvad enten det vedrører opgraderinger, nye

versioner, ændringer, tilpasninger, fejlhåndtering, rettelser eller andre forbedringer af

softwaren (fælles betegnet “opdateringer”), som Stages gør opmærksom på fra tid til

anden, eller som foretages af dig i overensstemmelse med normal brug af enheden og

al dokumentation. Softwaren kan omfatte software, datamålinger, algoritmer, formler,

varemærker og anden intellektuel ejendomsret givet i licens af en tredjepart til Stages til

anvendelse som en del af softwaren (“tredjeparts intellektuelle ejendomsret”). Stages

giver dig en ikke-overdragelig, ikke-eksklusiv, begrænset underlicens til at køre, vise, ud-

føre og bruge tredjeparters intellektuelle ejendomsret i overensstemmelse med licensen

givet ovenfor og med de øvrige brugs- og fortrolighedsbegrænsninger, som er anført i

denne softwarelicensaftale. Ovennævnte underlicens er med forbehold for følgende

yderligere betingelse: Tredjeparters intellektuelle ejendomsret bliver udelukkende an-

vendt i sammenhæng med tilladelig brug af softwaren, som godkendt specikt i denne

softwarelicensaftale.

Enheden giver dig eventuelt adgang til Stages’ websted og mobilapps (fælles betegnet

“teknologi”), og bestemte produktfunktioner, funktionaliteter og indholdstyper, hvortil der

er adgang på eller via enheden, kan være hostet på teknologien. Din adgang til og brug

af sådanne produktfunktioner, funktionaliteter og indholdstyper kræver eventuelt din

accept af bestemte, yderligere betingelser for anvendelse, regler eller principper, som

fremsættes af Stages i forbindelse med teknologien. Hvis du ikke accepterer, kan det

begrænse din adgang til og brug af bestemte produktfunktioner og funktionaliteter på

enheden. Overtrædelse af sådanne yderligere betingelser for anvendelse, regler eller

principper, som fremsættes af Stages, anses også for at være en overtrædelse af denne

softwarelicensaftale.

Softwaren, dokumentationen, objektkoden og kildekoden til softwaren, visuelle gengivel-

ser, skærmformater, rapportformater og øvrige designaspekter af softwaren, alle ideer,

metoder, algoritmer, formler og koncepter, som indgår i softwaren eller dokumentationen,

alle fremtidige opdateringer af softwaren samt alle aedte værker (hvor denne betingel-

se anvendes i amerikansk copyrightlovgivning) baseret på ovennævnte (fælles betegnet

“ophavsretsbeskyttet ejendom”) er forretningshemmeligheder og ophavsretsbeskyttet

ejendom tilhørende Stages og selskabets licensgivere og har stor kommerciel værdi for

Stages og selskabets licensgivere. Al ophavsretsbeskyttet ejendom stilles til rådighed for

dig på strengt fortrolig og begrænset anvendelsesbasis med forbehold af ovennævnte

licens. Adkomst til al ophavsretsbeskyttet ejendom samt alle relaterede patenter, op-

havsrettigheder, varemærker, databaserettigheder, forretningshemmeligheder, intellektu-

elle ejendomsrettigheder og øvrige ejendomsrettigheder tilhører udelukkende Stages og

selskabets licensgivere. Denne softwarelicensaftale er ikke en købsaftale, og du får in-

gen ejendomsrettigheder, patenter, ophavsrettigheder, varemærker, databaserettigheder,

forretningshemmeligheder, intellektuelle ejendomsrettigheder eller andre ejendomsret-

tigheder til ophavsretsbeskyttet ejendom i kraft af denne softwarelicensaftale eller ved

dit køb af enheden. Du må ikke, og må ikke tillade eventuelle tredjeparter at: (i) licensgive,

underlicensgive, videresælge, leje, låne, overføre, overdrage, distribuere eller på anden

vis kommercielt udnytte eller stille nogen som helst del af den ophavsretsbeskyttede

ejendom til rådighed for tredjeparter på nogen som helst måde; (ii) kopiere, ændre, til-

passe, oversætte eller skabe aedte værker af den ophavsretsbeskyttede ejendom; (iii)

anvende, integrere eller sammensætte den ophavsretsbeskyttede ejendom, eller andre

dele eller elementer heraf, med anden software, andre databaser eller tjenester, som ikke

leveres af Stages; (iv) foretage reverse engineering, dekompilere, disassemblere eller på

anden vis forsøge at aede strukturen af den ophavsretsbeskyttede ejendom; (v) omgå,

eller forsøge at omgå, eventuelle elektroniske foranstaltninger til regulering af eller kon-

trol med adgang til den ophavsretsbeskyttede ejendom; (vi) anvende den ophavsretsbe-

skyttede ejendom til ulovlige formål; (vii) anvende robotter, spidere, appbaserede søge-/

henteapplikationer eller andre manuelle eller automatiske enheder til at hente, indeksere,

“skrabe”, “dataminere” eller på nogen måde indsamle den ophavsretsbeskyttede ejen-

dom; (viii) fjerne, slette, ændre eller tilsløre varemærker eller andre ophavsrettigheder, va-

remærker, patenter eller andre intellektuelle eller ophavsretsbeskyttede ejendomsrettig-

heder på den ophavsretsbeskyttede ejendom. Stages forbeholder sig ret til at undersøge

og sagsøge overtrædelser af ovenstående forpligtelser i lovgivningens fulde omfang.

Stages kan vælge at involvere og samarbejde med retshåndhævende myndigheder ved

retsforfølgelse af brugere, der overtræder denne softwarelicensaftale.

Denne softwarelicensaftale er underlagt, fortolkes og nder anvendelse i overensstem-

melse med lovgivningen i staten Colorado, USA, uanset eventuel konikt i lovbestemmel-

ser. Du accepterer, at tvistigheder, som måtte opstå på grund af denne softwarelicens-

aftale, udelukkende kan bringes for forbunds- eller delstatsdomstole, som er beliggende

i eller har domsmyndighed i Boulder County, Colorado, og du giver samtykke til disse

domstoles domsmyndighed. Du frafalder hermed alle indsigelser, som du måtte have

nu eller efterfølgende, mod udøvelsen af sådanne forbunds- eller delstatsdomstoles per-

sonlige og saglige kompetence og mod placeringen af værneting i tilfælde af søgsmål,

påstævninger eller retsskridt, som rejses ved sådanne forbunds- eller delstatsdomstole.

Het Stages-apparaat beschikt mogelijk over functies die offroadroutes of paden tonen en

aanbevelen. Wees in dat geval heel voorzichtig bij het volgen van richtingsaanwijzingen

die niet met pijlen zijn aangegeven of die gevaarlijke routes voorstellen. Wees altijd voor-

zichtig, zowel op de weg als offroad.

WAT WORDT DOOR DEZE GARANTIE GEDEKT?

Stages Cycling garandeert het hardwareproduct en de accessoires van het merk Stages

Cycling in de originele verpakking (‘Stages Cycling-product’) tegen materiaal- en fabrica-

gefouten bij normaal gebruik, in overeenstemming met de door Stages Cycling gepubli-

ceerde richtsnoeren, gedurende een periode van EEN (1) JAAR vanaf de oorspronkelijke

aankoopdatum door de eindgebruiker (de ‘Garantieperiode’). Deze garantie is alleen gel-

dig voor de oorspronkelijke eigenaar en is niet overdraagbaar.

WAT WORDT NIET DOOR DEZE GARANTIE GEDEKT?

Deze garantie is van toepassing op producten van het merk Stages Cycling, met inbegrip

van maar niet beperkt tot crankarmen wanneer deze zijn verpakt of worden verkocht

met Stages Cycling-hardware. Andere fabrikanten, leveranciers of uitgevers dan Sta-

ges Cycling kunnen u hun eigen garanties verstrekken, maar Stages Cycling levert zijn

producten op eigen bate en schade, voor zover dat door de wet is toegestaan. Stages

Cycling garandeert niet dat de werking van het Stages Cycling-product ononderbroken of

foutloos zal zijn. Stages Cycling is niet verantwoordelijk voor schade die voortvloeit uit

niet-naleving van instructies met betrekking tot het gebruik van het Stages Cycling-pro-

duct. De gepubliceerde richtsnoeren van Stages Cycling omvatten maar zijn niet be-

perkt tot de informatie in de technische specicaties, de gebruikershandleidingen en de

serviceberichten.

Deze garantie is niet van toepassing op: (a) verbruiksonderdelen, zoals batterijen of be-

schermende coatings die na verloop van tijd onvermijdelijk minder goed presteren, ten-

zij het defect het gevolg is van een materiaal- of fabricagefout; (b) cosmetische schade,

met inbegrip van maar niet beperkt tot krassen en deuken; (c) schade veroorzaakt door

gebruik met een ander product; (d) schade veroorzaakt door een ongeval, een slag,

misbruik, verkeerd gebruik, brand, een aardbeving of een andere externe oorzaak; (e)

schade veroorzaakt door gebruik van het Stages Cycling-product dat niet overeenstemt

met de gepubliceerde richtsnoeren van Stages Cycling; (f) schade veroorzaakt door

service, modicaties of aanpassingen die niet zijn uitgevoerd door Stages Cycling of

een erkende Stages Cycling-serviceprovider; (h) defecten veroorzaakt door norma-

le slijtage of anderszins als gevolg van de normale veroudering van het Stages Cy-

cling-product, of (i) Stages Cycling-producten waarvan het serienummer is verwijderd

of onleesbaar gemaakt.

BELANGRIJKE BEPERKING

Stages Cycling kan de garantieservice beperken tot het land waar Stages Cycling of een

erkende distributeur het Stages Cycling-product oorspronkelijk heeft verkocht.

Softwarelicentieovereenkomst:

TE ZIJN. ALS U NIET INSTEMT MET AL DEZE VOORWAARDEN, DAN MAG U HET APPARAAT

NIET GEBRUIKEN.

Stages Cycling, LLC en zijn dochterondernemingen (‘Stages’) verlenen u een niet-over-

draagbaar, niet-exclusief beperkt recht en licentie voor de toegang tot en de uitvoering, de

weergave, de prestatie en het gebruik van de software in uitvoerbare vorm waarmee het ap-

paraat is uitgerust (de ‘Software’), en dit uitsluitend voor uw persoonlijke, niet-commerciële

gebruik in overeenstemming met de beoogde werking van het apparaat en alle gerelateer-

de documentatie die bij het apparaat is geleverd door Stages Cycling (‘Documentatie’). De

hierboven vermelde licentie is ook van toepassing op alle programmatische of functionele

verbeteringen en updates van de Software, of het nu gaat om upgrades, nieuwe versies, wij-

zigingen, aanpassingen, foutafhandeling, patches of andere verbeteringen van de Software

(gezamenlijk ‘Updates’ genoemd), die van tijd tot tijd op initiatief van Stages of van u worden

uitgevoerd in overeenstemming met de normale werking van het apparaat en alle docu-

mentatie. De Software kan software, gegevensstatistieken, algoritmen, formules, handels-

merken en andere intellectuele eigendom bevatten, die aan Stages in licentie zijn gegeven

door een derde partij voor gebruik als onderdeel van de Software (‘IE van derden’). Stages

verleent u een niet-overdraagbare, niet-exclusieve beperkte sublicentie om de IE van derden

uit te voeren, weer te geven, te laten presteren en te gebruiken, in overeenstemming met de

hierboven verleende licentie en de andere gebruiks- en vertrouwelijkheidsbeperkingen die in

deze Softwarelicentieovereenkomst zijn uiteengezet. De hierboven vermelde sublicentie is

onderworpen aan de volgende bijkomende voorwaarde: de IE van derden zal alleen worden

gebruikt in combinatie met de Software op een manier die uitdrukkelijk is toegestaan in deze

Softwarelicentieovereenkomst.

Het apparaat verleent u mogelijk toegang tot de website en de mobiele applicaties van

Stages (gezamenlijk ‘Technologie’ genoemd), waar bepaalde voorzieningen, functies en

content die op of via het apparaat toegankelijk zijn, worden gehost. Voor de toegang tot

en het gebruik van dergelijke voorzieningen, functies en content is het mogelijk dat Stages

u vraagt om bepaalde aanvullende gebruiksvoorwaarden, regels of beleidsregels in verband

met de Technologie te accepteren. Als u dat niet wenst te doen, dan wordt uw toegang tot of

het gebruik van bepaalde voorzieningen en functies van het apparaat mogelijk beperkt. Elke

schending van dergelijke aanvullende gebruiksvoorwaarden, regels of beleidsregels van Sta-

ges zal ook worden beschouwd als een schending van deze Softwarelicentieovereenkomst.

De Software, Documentatie, object- en broncode voor de Software, visuele uitdrukkingen,

schermindelingen, rapportindelingen en andere ontwerpkenmerken van de Software, maar

ook alle ideeën, methoden, algoritmen, formules en concepten die in de Software of Do-

cumentatie zijn opgenomen, alle toekomstige Updates van de Software en alle afgeleide

werken (zoals deze term wordt gehanteerd in het Amerikaanse auteursrecht) op basis van

een van de voorgaande (gezamenlijk ‘Auteursrechtelijk beschermde eigendom’) zijn bedrijfs-

geheimen en auteursrechtelijk beschermde eigendom van Stages en zijn licentiegevers die

voor hen een grote commerciële waarde hebben. Alle Auteursrechtelijk beschermde eigen-

dom wordt u ter beschikking gesteld voor gebruik op een strikt vertrouwelijke en beperkte

basis, onderworpen aan de hierboven vermelde licentie. Alle Auteursrechtelijk beschermde

eigendom en alle gerelateerde patenten, auteursrecht, merkenrecht, databankenrecht, be-

drijfsgeheimen, intellectuele eigendom en andere eigendomsrechten blijven de exclusieve

eigendom van Stages en zijn licentiegevers. Deze Softwarelicentieovereenkomst is geen

verkoopovereenkomst. Bijgevolg wordt er uit hoofde van deze overeenkomst of uw aankoop

van het apparaat geen eigendomsrecht, patent, auteursrecht, handelsmerk, bedrijfsgeheim,

intellectuele eigendom of andere eigendomsrechten aan u overgedragen. U zult de Au-

teursrechtelijk beschermde eigendom niet (en u zult ook derden dit niet toestaan): (i) onder

licentie of sublicentie geven, wederverkopen, verhuren, lenen, overdragen, toewijzen, verde-

len of anderszins commercieel exploiteren of beschikbaar maken aan derden; (ii) kopiëren,

modiceren, aanpassen, wijzigen, vertalen of er afgeleide werken van maken; (iii) gebruiken,

samenvoegen of verenigen (en ook geen enkel onderdeel of element daarvan) met andere

software, databases of diensten die niet door Stages worden aangeboden; (iv) omzetten

door middel van ‘reverse engineering’, decompileren, disassembleren of anderszins probe-

ren om de structuur van de Auteursrechtelijk beschermde eigendom in afgeleide werken

te gebruiken; (v) omzeilen of aanwezige elektronische beveiligingsmaatregelen proberen te

omzeilen om de toegang tot de Auteursrechtelijk beschermde eigendom te regelen of te con-

troleren; (vi) gebruiken voor illegale doeleinden; (vii) webindexeren, extraheren (‘scrapen’),

doorzoeken naar statische verbanden (‘datamining’) of op enigerlei wijze verzamelen met

behulp van een robot, ‘spider’, applicatie voor het zoeken naar apps of andere handmatige

of automatische apparaten; of (viii) ontdoen van de handelsmerken of de vermeldingen van

auteursrecht, handelsmerk, patent of andere intellectuele eigendom of eigendomsmatige

rechten, en deze ook niet wijzigen of onleesbaar maken. Stages behoudt zich het recht voor

om schendingen van een van de bovenstaande verplichtingen te onderzoeken en te vervol-

gen in de meest ruime zin van de wet. Stages mag samenwerken met wetshandhavers bij

het vervolgen van gebruikers die deze Softwarelicentieovereenkomst schenden.

Deze Softwarelicentieovereenkomst wordt beheerst, uitgelegd, geïnterpreteerd en toegepast

in overeenstemming met de wetten van de staat Colorado (VS), zonder inachtneming van de

collisieregels of de beginselen van rechtskeuze. U stemt ermee in dat de enige en exclusieve

jurisdictie en locatie voor alle geschillen die voortvloeien uit deze Softwarelicentieovereen-

komst een federale rechtbank of staatsrechtbank toekomt die gevestigd is in of die juris-

dictie heeft over Boulder (Colorado), en u gaat akkoord met de persoonlijke bevoegdheid

van deze rechtbanken. U doet hierbij afstand van alle eventuele bezwaren die u nu of in de

toekomst mogelijk hebt over de uitoefening van de persoonlijke en absolute bevoegdheid

door deze federale rechtbanken of staatsrechtbanken en over het kiezen van de plaats voor

een rechtszaak, rechtsgeding of vervolging in een dergelijke federale rechtbank of staats-

rechtbank.

Europa – EU-verklaring van overeenstemming. Foundation Fitness, LLC verklaart hierbij dat

de radioapparatuur van type SDM1 voldoet aan de richtlijn 2014/53/EU en de richtlijn van

de Europese Unie 2011/65/EU betreffende beperking van het gebruik van bepaalde gevaar-

lijke stoffen in elektrische en elektronische apparatuur, algemeen bekend als RoHS 2. De
