Warranty

LIMITED ONE YEAR PRODUCT WARRANTY
Smart Electrician warrants that its products are free of defects in workmanship or materials
under normal use and service for a period of one (1) year from the date of shipment. Smart
Electrician’s sole responsibility in the event of breach of warranty shall be, at Smart Electrician’s
election, to repair or provide replacement for the Product with respect to which such warranty is
breached or to return payments made with respect to such Product. In no event, including
breach or non-fulfillment of the foregoing limited warranty, shall Smart Electrician be liable for
loss of profits or incidental, indirect, consequential or special damages of any kind. The warranty
set forth in this paragraph is Smart Electrician’s sole warranty with respect to the Products.
Menard’s acknowledges and agrees that Smart Electrician is not liable for any representations
and/or warranties that Menard’s may have made or given to any customer or end-user of the
Products. Menard’s shall indemnify and hold Smart Electrician harmless from any claim of
violation of any such representation or warranty asserted by any third party against Smart
Electrician.
Smart Electrician’s makes no other warranty of any kind whatsoever, express or implied,
including, without limitation, any warranty against infringement of any third party’s intellectual
property rights, and all implied warranties of merchantability and fitness for a particular purpose
are hereby disclaimed by Smart Electrician and excluded from this agreement.
Obtaining Warranty Service
Customer must contact Menards within applicable warranty period to obtain warranty service.
Dated proof of original purchase from Smart Electrician or its authorized Reseller or Menard’s
will be required.
