WHAT IS COVERED BY THIS WARRANTY?
Unowhy US, Inc. (“UNOWHY”) guarantees the QOOQ tablet
hardware and accessories contained in the original packaging
which can be identied by the trademark “UNOWHY” and/or the
trademarks or tradename “QOOQ” and have the “UNOWHY” and/
or “QOOQ” logo axed to them (“Products”) against defects in
materials and workmanship when used normally in accordance
with UNOWHY’s instruction manual, inserts together with the
original packaging for the Product or any service communications
e-mailed or mailed to you (the “Published Guidelines”) for a period
of two (2) years from the date of original retail or online purchase
by the end-user purchaser (“Warranty Period”).

Unowhy US, Inc. (désigné ci-après par « UNOWHY ») garantit le
matériel et les accessoires de la tablette QOOQ, contenus dans
son emballage d’origine, pouvant être identiés par les marques
déposées « UNOWHY » ou « QOOQ », ou par l’appellation
commerciale « QOOQ » ainsi que par les logos de ces marques
apposés sur ces produits (désignés ci-après par « produits »),
contre tout vice de fabrication ou de matériau, dans des conditions
normales d’utilisation, conformes au manuel d’instructions publié
par UNOWHY inclus dans l’emballage d’origine du produit, ou
conforme à toute communication qui vous aura été adressée
par courrier électronique ou postal (« Instructions d’utilisation
publiées ») et ce, pour une période de (2) ans à compter de la date
d’achat chez un revendeur ou en ligne par l’acheteur nal (« Durée
de la garantie »).

WHAT IS NOT COVERED BY THIS WARRANTY?
This warranty does not apply to any non-UNOWHY or non-QOOQ
branded hardware products or any software, even if packaged or
sold with the Products. Manufacturers, suppliers, or publishers
of these other products or software, other than UNOWHY, may
provide their own warranties to you – please contact them for
further information. Software distributed by UNOWHY (including,
but not limited to Product system software) is not covered by this
warranty. Please refer to the licensing agreement accompanying
the software for details of your rights with respect to its use.
THIS WARRANTY DOES NOT APPLY TO
(a) damage caused by the use of the Product with other products
not sold by UNOWHY;
(b) damage caused by accident, misuse, or abuse of the Product;
(c) damage caused by a force majeure event, such as ood, re,
earthquake or other external and unpredictable causes;
(d) damage caused by the attempted repair or opening of
hardware by a person who is not a representative of UNOWHY or
an authorized service provider;
(e) a product or part of the product that has been modied
without the permission of UNOWHY;
(f) consumable parts such as batteries, unless damage is due to a
manufacturing defect;
(g) cosmetic damage such as scratches, scus, dents and broken
plastic parts, which does not impact the functionality of the
Product or its operation;
(h) products with the serial number removed or made unreadable;
(i) damage caused by commercial use of the Product ;
(j) damage resulting from failure to follow the Published
Guidelines.
CE QUI N’EST PAS COUVERT PAR CETTE GARANTIE
Cette garantie ne s’applique pas aux produits ni aux logiciels
n’étant pas de la marque UNOWHY ou QOOQ, même s’ils sont
emballés ou vendus avec les produits. Les fabricants, fournisseurs
ou éditeurs autres que UNOWHY peuvent fournir leurs propres
garanties : contactez-les pour toute information complémentaire.
Les logiciels distribués par UNOWHY (y compris, et de façon non
limitative, les logiciels système des produits) ne sont pas couverts
par cette garantie. Veuillez vous reporter au contrat de licence
accompagnant le logiciel pour les détails sur vos droits concernant
son utilisation.
CETTE GARANTIE NE S’APPLIQUE PAS
(a) aux dommages dus à l’utilisation du produit avec d’autres
produits non commercialisés par UNOWHY ;
(b) aux dommages causés par accident ou par une utilisation
inadéquate ou abusive du produit ;
(c) aux dommages dus à des causes de force majeure, comme une
inondation, un incendie, un séisme ou toute autres circonstances
imprévisibles ;
(d) aux dommages causés par une tentative de réparation ou par
l’ouverture du matériel par une personne n’étant pas représentant
ou prestataire agréé par UNOWHY ;
(e) à un produit ou une de ses pièces qui aura été modié sans
l’autorisation de UNOWHY ;
(f) aux consommables, comme les batteries, à moins que le
dommage ne soit imputable à un défaut de fabrication ;
(g) aux dommages superciels, comme des éraures, rayures,
bosses ou éléments en plastique cassés, , n’aectant pas les
fonctionnalités du produit ni son fonctionnement ;
(h) si le numéro de série du produit a été supprimé ou rendu
illisible ;
(i) aux dommages causé par un usage commercial du produit
(j) aux dommages résultant d’une utilisation non conforme aux
instructions d’utilisation publiées.

WHAT ARE UNOWHY’S OBLIGATIONS?
If a hardware defect arises and a valid claim is received within the
Warranty Period, UNOWHY will, at its discretion,
(i) repair the Product using new or previously used parts that are
equivalent to new in performance and reliability,
(ii) replace the Product with a device that is at least functionally
equivalent to the Product and is formed from new and/or
previously used parts that are equivalent to new in performance
and reliability, or (iii) provide a full refund of your purchase price of
the Product. In instances where warranty service does not require
the Product to be opened (e.g. replacement of a backstand),
UNOWHY may request that you replace certain user-installable
parts yourself.
A replacement part or Product, including a user-installable part
that has been installed in accordance with instructions provided by
UNOWHY, assumes the remaining term of the Warranty Period or
ninety (90) days from the date of replacement or repair, whichever
provides longer coverage for you. UNOWHY may request that that
you return a replaced Product or part.
When a Product or part is replaced or a refund provided, any
replacement item becomes your property and the replaced
or refunded item returned to UNOWHY becomes UNOWHY’s
property.
LES OBLIGATIONS DE UNOWHY
En cas de défaut matériel ou de réclamation valable reçue pendant
la durée de garantie, UNOWHY pourra, à son choix,
(i) réparer le produit en utilisant des pièces neuves ou des pièces
de performances et de abilité équivalentes à celles d’une pièce
neuve,
(ii) remplacer le produit par un produit dont les fonctions sont au
moins équivalentes à celles du produit d’origine et constitué de
pièces neuves et/ou de pièces usagées équivalentes aux pièces
neuves en performances et en abilité,
ou (iii) rembourser totalement le prix payé pour l’achat du produit.
Dans les cas où la garantie ne requiert pas l’ouverture du produit
(remplacement du support arrière par exemple), UNOWHY pourra
vous demander de remplacer vous-même la pièce.
Un produit ou une pièce de rechange, notamment une pièce
pouvant être installée par l’utilisateur et qui aura été installée
conformément aux instructions fournies par UNOWHY, sera
garantie pour la plus longue des durées suivantes : le reste de la
durée de garantie d’origine ou une durée de quatre-vingt-dix (90)
jours à compter de la date du remplacement ou de la réparation.
UNOWHY pourra exiger le retour du produit ou de la pièce
remplacée.
Lorsqu’un produit ou une pièce est échangé(e) ou remboursé(e),
toute pièce de rechange devient votre propriété et la pièce
échangée ou remboursée retournée devient la propriété de
UNOWHY.

HOW DO I OBTAIN WARRANTY SERVICE?
To obtain assistance on where to return the Product, please contact
UNOWHY customer service by phone at 646-513-2993 or e-mail at
[e-mail]. If UNOWHY determines that any Product is
not covered by this warranty, you must pay all parts, shipping, and
labor charges for the repair or return of such Product. If requested
by UNOWHY, you must furnish the sales receipt or comparable
proof of sale showing the original date of purchase in order to
show that the Product is within the warranty period, the serial
number of the Product and the seller’s name and address.
COMMENT OBTENIR LE SERVICE DE GARANTIE?
Pour toute assistance ou question sur l’adresse à laquelle envoyer
le produit, veuillez contacter le service client UNOWHY en
envoyant un e-mail à [e-mail]. Si UNOWHY considère
que le produit n’est pas couvert par la présente garantie, tous les
frais de pièces, d’expédition, de main d’oeuvre de réparation et de
retour du produit seront à votre charge. Si UNOWHY le demande,
il vous faudra fournir la facture ou tout autre preuve d’achat,
comportant la date d’achat an de prouver que le produit est
encore sous garantie, le numéro de série du produit ainsi que le
nom et l’adresse du revendeur.

PROVISION OF WARRANTY SERVICE
In the event that UNOWHY determines that your Product is eligible
for warranty service, UNOWHY will generally provide warranty
service through mail-in service, in which case you must return the
Product to an authorized Product service facility in an adequate
container for shipping in accordance with instructions furnished
by UNOWHY. In instances where warranty service does not require
the Product to be opened (e.g. replacement of a backstand),
UNOWHY may request that you replace certain user-installable
parts yourself.
In such cases, UNOWHY will ship a replacement part to you with
installation instructions, if applicable, and any requirements for
the return of the replaced part. You are responsible for labor costs
incured in connection with installation of the replacement part.
Should you require further assistance installing a replacement part,
please contact UNOWHY at the telephone number listed above.
In the event that UNOWHY requires return of the replaced Product
or part, but is willing to provide the replacement Product or part
prior to receipt of the replaced Product or part, UNOWHY may
require a credit card authorization as security for the retail price
of the replacement Product or part and applicable shipping costs.
If you follow the instructions for returning the replaced Product or
part, UNOWHY will cancel the credit card authorization, so you will
not be charged for the Product. If you fail to return the replaced
Product or part as instructed or return a replaced Product or part
that is ineligible for service, UNOWHY will charge your credit card
for the authorized amount.
If UNOWHY does not require return of the replaced Product
or part, UNOWHY will ship you a replacement Product or part
accompanied by instructions on installation, if applicable, and any
requirements for the disposal of the replaced Product or part.
UNOWHY reserves the right to change the method by which
UNOWHY may provide warranty service to you, and your Product’s
eligibility to receive a particular method of warranty service.
UNOWHY reserves the right to charge you shipping costs in
connection with its provision of warranty service.
It is possible that some or all of the contents may be deleted or
reformatted during the course of warranty service, and UNOWHY
will not be responsible for any such damage or loss.
PRESTATION DU SERVICE DE GARANTIE
Si votre produit est considéré comme couvert par la garantie,
UNOWHY eectuera en règle générale le service de garantie
par voie postale, auquel cas vous devrez envoyer le produit à un
service de réparation agréé dans un contenant approprié à son
expédition, conformément aux instructions qui vous auront été
fournies par UNOWHY.
Dans certains cas où le service de garantie ne requiert pas
l’ouverture du produit (remplacement d’un support arrière par
exemple), UNOWHY pourra vous demander de remplacer vous-
même la pièce. Dans ce cas, UNOWHY vous expédiera la pièce de
rechange avec des instructions d’installation si nécessaire et toutes
les indications pour la réexpédition de la pièce remplacée.
Tout coût de main d’oeuvre relatif à l’installation de la pièce de
rechange est à votre charge. Si vous avez besoin d’une assistance
particulière pour installer la pièce de rechange, veuillez contacter
UNOWHY au numéro de téléphone indiqué ci-dessus.
Si UNOWHY requiert le retour du produit ou de la pièce remplacée,
et dans l’attente de la réception de la pièce ou du produit à
remplacer : UNOWHY peut demander une autorisation de
prélèvement sur votre carte de crédit pour couvrir les coûts du
produit ou de la pièce de rechange ainsi que les frais d’expédition
correspondants. Si vous suivez les instructions de retour de la
pièce ou du produit de rechange, UNOWHY annulera l’autorisation
de prélèvement et votre carte ne sera pas débitée. Si vous ne
retournez pas le produit ou la pièce remplacée comme indiqué, ou
si les conditions permettant de bénécier du service de garantie
ne sont pas remplies, UNOWHY débitera la carte de crédit du
montant autorisé.
Si UNOWHY ne requiert pas le retour de la pièce ou du produit
remplacé : UNOWHY vous enverra la pièce ou le produit de
rechange accompagné des instructions d’installation si nécessaire,
ainsi que toutes les indications pour vous débarrasser de la pièce
ou du produit remplacé.
UNOWHY se réserve le droit de changer le mode de prestation
du service de garantie ainsi que les conditions particulières de
garantie de votre produit. UNOWHY se réserve le droit de vous
facturer les frais d’expédition relatifs au service de garantie.
UNOWHY ne sera pas tenu responsable des dommages ou des
pertes dus à la suppression ou au reformatage des contenus au
cours du service de garantie.

LIMITATIONS
TO THE EXTENT PERMITTED BY LAW, THE LIMITED WARRANTY
SET FORTH ABOVE IS EXCLUSIVE AND IN LIEU OF ALL OTHER
WARRANTIES AND REMEDIES, AND UNOWHY SPECIFICALLY
DISCLAIMS ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING,
BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE AND AGAINST HIDDEN
OR LATENT DEFECTS. IF UNOWHY CANNOT LAWFULLY DISCLAIM
STATUTORY OR IMPLIED WARRANTIES, THEN TO THE EXTENT
PERMITTED BY LAW, ALL SUCH WARRANTIES SHALL BE LIMITED
IN DURATION TO THE DURATION OF THIS EXPRESS LIMITED
WARRANTY AND TO REPAIR OR REPLACEMENT OF THE PRODUCT
AND PARTS OR A REFUND OF THE PRODUCT PURCHASE PRICE AS
DETERMINED BY UNOWHY IN ITS SOLE DISCRETION. SOME STATES
AND JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG
AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY
NOT APPLY TO YOU.
UNOWHY IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL
OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH
OF WARRANTY OR UNDER ANY OTHER LEGAL THEORY. SOME
STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR
LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO
THE ABOVE EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU.
LIMITATIONS

NO MODIFICATIONS; SEVERABILITY
No UNOWHY employee, agent, or representative is authorized
to make any modication to this warranty. If any portion of this
warranty is held to be illegal or unenforceable, the legality or
enforceability of the remaining terms shall not be aected or
impaired.

UNOWHY WARRANTY
The UNOWHY company (hereinafter UNOWHY) is committed
to ensuring that the QOOQ product works properly. To this end,
UNOWHY, whose headquarters are located at 80bis, rue Danjou,
92100 Boulogne Billancourt, FRANCE agrees to repair or replace
any QOOQ unit and accessories with a defect in materials or
workmanship, excluding batteries, for a period of two (2) years
from the date of purchasing at www.qooq.com.
Proof of purchase (invoice or receipt) will be required for any repair
claims during this warranty period.
In the event of a repair claim for a QOOQ unit covered by this
warranty, the repair period spent on repairing the unit—a period
of at least SEVEN (7) days—will be added to the remaining
warranty period.
No dealer, agent, or employee of Unowhy is authorized to make
any modications, extension, or additions to this warranty.
EXCLUSIONS AND LIMITATIONS TO THE WARRANTY
The UNOWHY warranty is limited to repair or replacement;
the decision to repair or replace the QOOQ unit is solely at the
discretion of UNOWHY.
This warranty applies only to products manufactured by or for
UNOWHY that can be identied by the “UNOWHY” and/or “QOOQ”
trademark, trade name, or logo axed to them.
This warranty does not apply to any products not marketed under
the “UNOWHY” and/or “QOOQ” trademark, even if packaged or
sold with the QOOQ unit.
THIS WARRANTY DOES NOT APPLY
(a) to damage caused by use of QOOQ unit with products not
marketed by UNOWHY;
(b) to damage caused by accident or misuse of the product;
(c) to damage caused by an event of force majeure such as: ood,
re, earthquake or other unpredictable external causes;
(d) to damage caused by service performed by anyone who is not
a representative of UNOWHY or an authorized service provider;
(e) to a product or part that was modied without the permission
of UNOWHY;
(f) to consumable parts, such as batteries, unless damage has
occurred due to a defect in workmanship;
(g) to any cosmetic damage such as scratches, scus, dents, or
broken plastic parts that do not aect the functionality or correct
operation of the product;
(h) if the QOOQ unit serial number has been removed or defaced.
UNOWHY does not guarantee its ability to repair or exchange
any product at the end of this warranty without any risk or loss of
programs or data. It is therefore recommended to create backups
before implementation of this warranty.
UNOWHY shall not be held liable for any direct, indirect, special or
consequential damage resulting from the loss or damage to data,
nor for any costs of recovering, programming, or reproducing any
program or data stored or used with UNOWHY products.
LEGAL GUARANTEES
The warranty described above does not exclude benet of the
legal guarantees granted to non-professional purchasers. This
includes guarantees resulting from the following provisions : the
QOOQ tablet.
Article 1641 of the Civil Code
A seller is bound to a warranty on account of the latent defects of
the object sold which render it unt for the use for which it was
intended, or which so impair that use that the buyer would not
have acquired it, or would only have paid a reduced price for it,
had he known of them.
Article 1648-1 of the Civil Code
The action resulting from the defects giving rise to the right to
cancellation must be brought by the buyer within a period of two
years following the discovery of such defect.
Article L211-4 of the Consumer Code
The seller is required to deliver a product which conforms to the
contract and is held liable for any lack of conformity existing upon
delivery. The seller is also held liable for any lack of conformity
caused by the packaging or the assembly instructions or the
installation if the seller assumed responsibility thereof or had it
carried out under its responsibility.
Article L211-5 of the Consumer Code
To conform to the contract, the product must:
1° Be suitable for the purpose usually associated with such a
product and, if applicable:
- correspond to the description given by the seller and have the
features that the seller presented to the buyer in the form of a
sample or model;
- have the features that a buyer might reasonably expect it to
have considering the public statements made by the seller, the
producer or his representative, including advertising and labeling;
2° Have the features dened by mutual agreement between the
parties or be suitable for any special requirement of the buyer
which was made known to the seller and which the latter agreed
to.
Article L211-12 of the Consumer Code
Action resulting from lack of conformity lapses two years after
delivery of the product.
